Ministro Luis Felipe Salomão coordena pesquisa sobre cenário da recuperação de crédito no país
O ministro do Superior Tribunal de Justiça (STJ) Luis Felipe Salomão está à frente do recém-lançado estudo Métricas de Qualidade e Efetividade da Justiça Brasileira: o tempo e o custo de um processo de recuperação de crédito, promovido pela Associação dos Magistrados Brasileiros (AMB) e pela Fundação Getulio Vargas (FGV). Sob a coordenação científica da professora e cientista política da Universidade de São Paulo (USP) Maria Tereza Sadek, a pesquisa vai avaliar o custo e o tempo das ações de recuperação judicial e identificar os gargalos do processo na perspectiva de magistrados, advogados e empresas.
Para Luis Felipe Salomão, o aprofundamento do debate sobre a legislação e a prática da recuperação de crédito no país poderá gerar estímulo aos investimentos. Diretor do Centro de Pesquisas Judiciais da AMB, Salomão defende que todos os atores do sistema de Justiça devem estar preparados para o maior volume de demandas de recuperação em razão da pandemia da Covid-19.
“A expectativa é que até 80% das empresas vão enfrentar algum tipo de dificuldade decorrente da atual crise global. Este momento tão delicado demanda do Judiciário, cada vez mais, planejamento e estratégia para se evitar maiores prejuízos sociais e econômicos”, destaca.
Como funciona
O estudo analisará os fatores que possam ter contribuído para a melhor avaliação de outros países no ranking do Doing Business, elaborado pelo Banco Mundial. A pesquisa tem como público-alvo magistrados, advogados especializados, tribunais de justiça, empresas, o Conselho Nacional de Justiça e o Banco Mundial.
Os formulários terão os dados tabulados e discutidos até se chegar aos resultados preliminares, que devem ser detalhados para a produção do relatório final. Segundo a juíza e secretária-geral do Centro de Pesquisas Judiciais da AMB, Patrícia Cerqueira Kertzman Szporer, os questionários aplicados possuem enfoques específicos para cada grupo de participantes.
“O ministro Luis Felipe Salomão não quis restringir a pesquisa à visão dos membros do Poder Judiciário, mas também deseja conhecer o ponto de vista do jurisdicionado, das empresas recuperandas, dos advogados, em um amplo debate democrático sobre o presente e o futuro da recuperação judicial no Brasil”, ressalta.
O estudo é desenvolvido em parceria com o Fórum Nacional de Juízes de Competência Empresarial (Fonajem), a Universidade Federal Fluminense (UFF) e a Universidade Estadual do Rio de Janeiro (Uerj), com o apoio do Instituto Recupera Brasil (IRB). A previsão é que o trabalho seja concluído até o fim deste primeiro semestre.
